Questions people ask
What is deferred disposition in the Baytown Municipal Court, and can it keep a ticket off my driving record?
The city adds a warning. Deferred disposition may not be granted, because of the type of charge or your criminal history. If the court denies your request, your case may be set for a court appearance so you can talk to the judge about your situation. A request on a non-traffic violation must be made to the judge.
What it is
Deferred disposition is similar to probation. You are charged, but the court holds off on finding you guilty. If you follow the terms for the set period, the judge signs an order to dismiss the charge. The city says people ask for it to keep a moving traffic violation from appearing on their driving record.
Who can ask
You may be eligible if you are charged with a traffic offense. You may ask in person or in writing. You lose the right if you do not request it on or before your first appearance date, so do not wait until after that date.

What it costs and how long it lasts
You pay a special expense fee equal to your fine plus $50. The deferral period usually runs 90 to 180 days.
A driver under 25 who asks for deferred disposition on a moving traffic violation must also complete a driving safety course. The certificate must be returned to the court no later than 90 days after the starting date of the deferral term. For a juvenile, the paperwork cannot be processed unless it is granted in open court with a parent or legal guardian present.
The insurance version
A special version covers the charge called Failure to Maintain Financial Responsibility, which is driving without proof of insurance. You may be eligible if you had insurance on your first appearance date. You must keep insurance for the entire deferral period. As with other tickets, you pay a special expense fee of your fine plus $50 and the period usually runs 90 to 180 days. At the end, you bring proof so the court can check that you were covered the whole time.
What happens at the end
If you meet the terms, the judge signs an order to dismiss. If you break the terms, the court sets a show cause hearing, where you explain. If you do not comply, the judge may find you guilty, and a conviction may then be reported to your driving record.
How to ask
You can ask in person at the court, or send an online request. The city's page says you will need a valid driver's license and an insurance ID card. The Municipal Court is at 3120 N. Main Street. Hours are Monday through Thursday, 7:30 a.m. to 5:30 p.m., and Friday, 7:30 a.m. to 11:30 a.m.
