My car was towed in Baytown: who has it, what it can cost and what you can do
The city also says the sooner you collect your vehicle, the lower the cost will be. The company accepts cash, debit cards and credit cards.
Who has my car if the police ordered the tow?
The City of Baytown has a contract with Baytown Wrecker Service, Inc. to do all regular towing and storage that is not requested by the owner. The city calls these non-consent tows, and they include tows that a peace officer starts, such as after a crash. The company's address is 5552 N. Main, Baytown, 77521. To get your car back or to ask about a specific tow, contact the company directly. The city's Tow Trucks page lists the company's phone number, and we leave phone numbers off this page.
What the city allows the company to charge
The city's page says only three fees are allowed for a regular tow inside the city: - A regular in-city non-consent tow: $150. - Storage at the company's lot: $20 per day. A day begins and ends at midnight. - A transfer to anywhere inside the Baytown city limits: $60.
The city also says the sooner you collect your vehicle, the lower the cost will be. The company accepts cash, debit cards and credit cards.
Your rights when the city's tow company shows up
The city lists these points for tows it has contracted: - You must receive and sign a City of Baytown tow truck ticket that shows the fees. You do not have to sign any other form about the tow at the scene of an accident. - You can take your belongings out of the vehicle at the scene or at the storage lot, within one hour after you call the company and ask for access. - The company cannot solicit you at the scene of an accident. You have the right to have your vehicle towed to any location inside the city limits and to use the repair shop you choose. - The company's drivers and vehicles are licensed by the city, and each should show a city-issued driver ID and a vehicle inspection sticker.
If you think you were overcharged
The city says to work with the company first. If you cannot settle it, you can file a written complaint with the Baytown Police Department, the Texas Department of Licensing and Regulation, or both. The Police Department's Tow Trucks page has a compliment and complaint form. TDLR takes complaints online about tow companies, tow operators, vehicle storage facilities and booting companies.
If your car was towed from a private lot
Apartment complexes, shopping centers and other private lots are covered by state rules from TDLR rather than the city contract. In short: - If the hookup is not finished, you can have the car released at no charge without proving ownership. If the hookup is finished but the car is still in the lot, you can pay a drop fee to keep it. The state maximum is $135 for a vehicle of 10,000 pounds or less, and local rules can set it lower but never higher. The driver must take cash, credit cards and debit cards. - If the car is already gone, call the number on the tow-away sign. If a boot is on your car, call the number on the warning sticker and do not remove the boot or drive with it. - To pick up a car at a vehicle storage facility, bring a photo ID and proof that you own the car or may use it, such as a title, an insurance card naming you, a driver's license that matches the registration, or a signed lease or rental agreement. You pay the allowed towing and storage fees to take the car. - You can get your ownership papers and personal belongings out of the car at no charge. You cannot remove parts that are attached to the car. - If the storage facility is not open 24 hours, it must release your car within one hour of your request from 8 a.m. to midnight Monday through Saturday and from 8 a.m. to 5 p.m. on Sundays, except on nationally recognized holidays. - The state's daily storage limit is $20 for cars of 25 feet or less, adjusted every two years. TDLR lists $22.85 per day as the 2023 amount for those cars. Ask the lot for its posted fee schedule, which it must show on request.
If you think the tow was wrong
Texas lets you ask a Justice of the Peace court for a tow hearing. You must file before the 14th day after the car was placed in storage or booted, not counting Saturdays, Sundays and national holidays. The filing fee is $20, and the court must hold the hearing within 21 calendar days. Bring photos of the parking signs, or note that none were posted, plus the receipt or notice you were given. A hearing request does not replace a TDLR complaint, and you can do both. TDLR cautions that this summary is not a full description of your rights.
A free tow
We found no City of Baytown program that tows cars for free, and the city's page lists the fees above. If your car breaks down in a spot that is not safe, such as in a traffic lane on a freeway, get yourself out of danger and call 911.
Before you go
- Gather a photo ID and proof you own the car or may use it before you go to the storage lot.
- Bring a way to pay: the city's tow company takes cash, debit cards and credit cards.
- If you need your belongings, call and ask for access, then take them out within the hour the city allows.
- Keep your tow ticket and photos of the signs and the car.
- Ask for the fee schedule and compare it with the city's amounts.
- If the tow came with a ticket, see how to respond to a citation.
