Baytown rules, answered

Can I park the boat in the driveway? How tall can my fence be? Do I need a permit for a garage sale? The answers are in the City of Baytown's Code of Ordinances, a long legal document most people never open. We read it so you don't have to.

Each answer below gives the rule in plain words, the exact section of the city code it comes from, what happens if you break it, and who to call at the city. These rules apply inside Baytown city limits. Some, like fireworks, noise and weeds, also reach 5,000 feet past the city line. If you live in an unincorporated area such as Highlands or McNair, county and state rules apply instead, and we say so where it matters.

The rules

The fine print

The city code changes. These answers come from the version codified through Ordinance No. 16,503 (June 2026), plus newer ordinances where we note them. Deed restrictions and HOA rules can be stricter than the city's, and the city does not enforce those. This page explains the rules; it is not legal advice. If something on your property depends on it, ask the city department named in the answer before you build or buy.

Unless a section sets its own penalty, the default fine for breaking a city rule is up to $500. Violations involving fire safety, zoning, or public health and sanitation can be fined up to $2,000, and illegal dumping of refuse up to $4,000. Each day a violation continues counts as a separate offense (City Code Sec. 1-14). Some sections set their own penalty; the traffic chapter, for example, caps most parking fines at $200 (Sec. 94-2).
