Height

"No residential fence shall be installed more than eight feet in height." City Code Sec. 18-1042 sets that single cap and doesn't give a separate, lower number for front yards. If the city limits fences along the street, that rule would sit in the Unified Land Development Code rather than in the fence section, and your deed restrictions or HOA may be stricter than either. Before you build a tall fence along the street, ask Planning and Development Services in writing what the front-yard limit is for your lot, and get the answer before you buy lumber.

A fence also can't be built so that it is a "visual traffic obstruction" for drivers. Corner lots and driveways are where that rule bites, so keep the fence back from where drivers need to see.

Rule: City Code Sec. 18-1042.

Permit

You need a building permit to install a residential fence (Sec. 18-1041). The city's permit guide says a permit is required to install or replace 50 percent or more of a fence; minor repairs of less than 50 percent don't need one.

To apply, contact Planning and Development Services, Building Services and Inspections, through the City of Baytown (baytown.org). Ask what they want with the application, such as a site plan or a copy of your survey showing property lines, what the fee is and how long review takes. Those details are not in the permit guide's summary, so don't assume.

Materials

The code lists approved materials, including rough cedar, chain link, wrought iron and masonry columns combined with one of the listed materials. Ask Building Services to confirm that the material you want is on the list. "All plywood materials are prohibited." (Sec. 18-1042.)

Pools

If you have a swimming pool, it must be completely enclosed, either by a fence made of the materials listed in City Code Sec. 18-1011, or by a wall or other solid structure meeting the state's pool-enclosure law, Texas Health and Safety Code Chapter 757 (City Code Sec. 18-1134). Chapter 757 sets an enclosure at least 48 inches high, with gates that are self-closing and self-latching. By its own terms, that state law applies to pools at apartment complexes and homeowners associations, so ask the Building Inspections Division which standard applies to your pool. Pools 24 inches deep or more, hot tubs and spas also need a permit.

What happens if you don't

The general city penalty applies: a fine of up to $500, and each day counts as a new offense (Sec. 1-14).

Si no cumple
