New Year's in Baytown

You can buy fireworks in Texas from December 20 through midnight on January 1. That doesn't mean you can legally set them off inside Baytown or Mont Belvieu city limits — those are two different laws, and knowing which one applies to you is most of what you need to know before New Year's Eve here.

When you can buy them, and when you can't shoot them

Texas sets a statewide retail fireworks selling season for the New Year's holiday running December 20 through midnight on January 1, under rules from the Texas Department of Insurance's State Fire Marshal's Office. The Harris County Fire Marshal's Office lists two selling windows a year for consumer fireworks, one around the Fourth of July and this one. That's a sales window, not a permission slip to light them anywhere. Chambers County's own fireworks page says the cities of Anahuac, Baytown, Mont Belvieu and Old River-Winfree prohibit fireworks sales and use within their limits, a rule that holds in a wet year too. If you're staying inside either Baytown or Mont Belvieu, the legal place to use what you bought is outside the city line, in unincorporated Harris County or unincorporated Chambers County, where county rules and any burn ban apply instead. Highlands and Crosby are both unincorporated. Beach City and Cove and Old River-Winfree are small incorporated cities in Chambers County, so ask the city before you light anything there (numbers here). Chambers County says consumer fireworks are legal in its unincorporated areas unless the County Judge has ordered otherwise, so the county's rule can change in a dry year.

Where the stands are

Three firework retailers in our database are listed in the ring around Baytown rather than inside the city. Williams Fireworks is at 9040 FM 1405 Road. Big Time Fireworks is at 4326 FM 1942 and TOPDOG Fireworks is at 106 Kennings Road, both in the Crosby area, which is unincorporated; TOPDOG's listing shows 10 a.m. to 4 p.m. daily, which is worth confirming in season.

A few rules apply at the counter. Texas rules bar retailers from selling to anyone under 16 and require a reasonable effort to check age. Fireworks can't be sold or lit within 100 feet of a place where flammable liquids or compressed gases are stored and dispensed, which is why you won't light one in a gas station lot.

Burn bans don't automatically ban fireworks — but check anyway

Here's the part that trips people up: a county burn ban and a fireworks ban are two separate legal things in Texas. The burn-ban statute (Local Government Code §352.081) doesn't mention fireworks at all, and the Texas Association of Counties says a commissioners court can regulate fireworks under a separate statute (§352.051) only in limited circumstances, while the county judge can restrict them through a declaration of local disaster. A standard burn ban, on its own, does not automatically make fireworks illegal in unincorporated Harris or Chambers County. The burn-ban statute points counties to the Keetch-Byram Drought Index and caps an order at 90 days from the day it is adopted. Restricting fireworks takes its own commissioners court order, adopted by December 15 for the year-end season, so "there's a burn ban" is not automatically the same as "fireworks are banned." Burn bans are in effect in both counties around Baytown right now: Harris County's, for its unincorporated area, since September 17, 2026, and Chambers County's since September 24, 2026. They can end on short notice, so check our burn ban page the week of, not weeks ahead.

Watch parties and events

Baytown's own fireworks show is the Fourth of July celebration at Bicentennial Park, not New Year's. Downtown Houston's celebration is the nearest big midnight show, 30 to 45 minutes away depending on traffic, and its details usually go up in November.

For a low-key evening without fireworks, the city's Holiday Hangout at Town Square, 213 West Texas Avenue, is listed for December 3 to January 5 this season, with a full-size outdoor skating rink, a hay maze, glow activities and yard games (last season it ran December 5 to January 6 with a roller rink and mini golf). The city lists the Hangout as closed on Christmas Eve, Christmas Day, New Year's Eve and New Year's Day, so it is not a New Year's Eve plan; on the other nights it is open Monday through Thursday from 4 to 9 p.m. and Friday through Sunday from 2 to 9 p.m. Ticket prices are not posted yet. See the Holiday Hangout guide. Hooky Entertainment Baytown at 10550 Interstate 10 Service Road has IMAX movies, bowling and an arcade, with listed hours of 10 a.m. to midnight daily. The holiday season around the square is covered in Christmas in Baytown.

Trash and offices on January 1

Best Trash lists the City of Baytown, Harris MUD 106 and Harris MUD 290 for regular collection on New Year's Day, Friday, January 1, 2027. Other Best Trash customers have delayed service, with trash resuming Tuesday, January 5 and recycling Friday, January 8. The city has not posted whether offices close on January 1.

Safe rides home

If you're heading into Houston, check METRO's site for whether this year's New Year's Eve free-ride offer applies; it has varied. Locally, a rideshare is the standard fallback. Plan the ride home before the first drink.

The weather, and the pipes

New Year's here is usually mild, but this is also the stretch when a cold front can drop temperatures fast, so check the weather page before you assume it. If a hard freeze is forecast, drip your faucets, disconnect and drain outdoor hoses, and wrap or cover exposed pipes and spigots before you go out.

The plant doesn't get a countdown

The plant has no New Year is the essay to read for why the loudest hour of the Baytown night happens against a skyline that doesn't pause for it. The units along the Ship Channel run straight through like any other night, and somewhere in town a plant worker is watching the new year come in from a control room.

Before you go

Confirm which city or county you will be standing in before you light anything, because the same fireworks are legal in one place and illegal a few miles away.

Check the burn ban page and the Chambers or Harris County fire marshal's notices the week of, since a county judge can restrict fireworks in a dry year.

Keep a bucket of water or sand nearby, light one firework at a time, never relight a dud, and never let children light them, which is the Harris County Fire Marshal's own advice.

Keep pets indoors during fireworks, and make sure they are microchipped in case one bolts.

If the plan involves driving anywhere after midnight, make the ride plan before the first round, not after.

Questions people ask

When can you buy fireworks in Texas for New Year's? December 20 through midnight on January 1, statewide. Can I shoot fireworks in Baytown? No — Baytown bans fireworks sales and use inside city limits, regardless of the sales season, according to Chambers County. What about Mont Belvieu? Same — banned inside city limits, city parks included, and fireworks found in your possession can be confiscated and a citation issued. Does a burn ban mean fireworks are illegal too? Not automatically — a burn ban and a fireworks restriction are separate orders in Texas law, so check the current status rather than assume either way. Is there a public fireworks show in Baytown? The city's fireworks show is on July 4; for New Year's, anything announced goes on the events board, and Houston's downtown celebration is the nearest large public show. Will pipes freeze on New Year's here? Not most years, but a hard freeze is possible — drip faucets and cover outdoor pipes if one's forecast.
