(7) The owner's, lienholder's and mortgagee's right to appear and be heard at a hearing to contest the demolition order;

(8) The written request necessary for such a hearing;

(9) The date by which the owner and each lienholder and mortgagee must request in writing the hearing in order to receive it, which deadline may be no sooner than 20 days from the date of the receipt of the order; and

(10) The basis on which an appeal may be requested, namely that the true intent of this section has been incorrectly interpreted.

(c) If, after the chief building official has complied with the notice requirements as described in subsection (b), the owner or any lienholder and mortgagee do not request a hearing for review of the demolition order within the specified time, the demolition order shall be deemed final.

(d) If a hearing to review the demolition order is requested, the hearing shall be presided over by the construction board of adjustments and appeals. If the construction board of adjustments and appeals finds in favor of the owner or any lienholder or mortgagee, the demolition order shall be extinguished. If the construction board of adjustments and appeals finds against the owner or any lienholder or mortgagee, the demolition order shall remain in full force and effect and be deemed final. The construction board of adjustments and appeals shall have the power to fashion other reliefs as would be equitable.

(e) If the demolition order is deemed final and the owner of the premises fails to comply with the demolition order within the time prescribed in the order, the chief building official shall cause the structure to be razed and removed. If the city incurs expenses under this section, the city shall assess the expenses on and the city shall have a lien against the property. (4) Depositing the notice on or near the front door of the pool if the personal service cannot be obtained and the owner's post office address is unknown.

The notice must contain:

(1) An identification, which is not required to be a legal description, of the pool enclosure and the property on which it is located;

The lien is extinguished if the property owner or another person having an interest in the legal title to the property reimburses the city for the expenses. The lien arises and attaches to the property at the time the notice of the lien is recorded in the office of the county clerk in the county in which the property is situated. The notice must contain the name and address of the owner if that information can be determined with reasonable effort, a legal description of the real property on which the swimming pool or the enclosure or fence is situated, the amount of the expenses incurred by the city and the balance due.
