Baytown's sewer case: four years of talks, and what it means for your bill

In April 2022, the federal government and the State of Texas sued the City of Baytown over sewage spills and treatment-plant violations. The case has been paused ever since while the two sides negotiate a settlement. Here is what the lawsuit says, where the talks stand, and how it connects to the work, and the sewer rates, in the city's new budget.

What the lawsuit says

The United States and Texas filed the case on April 21, 2022, in federal court in Houston, under the Clean Water Act and the Texas Water Code. The complaint makes two kinds of claims.

The first is about overflows. A sanitary sewer overflow is raw sewage escaping from the pipes, manholes or pump stations before it reaches a treatment plant. The complaint says that on more than 800 occasions since April 2017, Baytown released untreated sewage from its collection system. It names the waters that received it: Black Duck Bay, Cedar Bayou, Tabbs Bay, Goose Creek, Cary Creek, Burnett Bay, Scott Bay and Spring Gully.

The second is about the city's four wastewater treatment plants, the Northeast, West, East and Central District plants. The complaint says their discharges broke the limits in their state permits, and that the city did not properly run and maintain the system.

The government asked the court to order the city to fix the system and to pay civil penalties.

Bayou City Waterkeeper, a Houston environmental group that had threatened its own lawsuit, filed its own complaint in the case in May 2022. Its count is 882 overflows releasing about 21 million gallons from 2016 to 2021. It says the largest spills disproportionately affected Hispanic neighborhoods.

Where the talks stand

In September 2022, at the parties' joint request, the judge stayed the case and closed it administratively while they negotiate. Since then, they have filed periodic status reports.

The latest public one, filed July 30, 2026, by the United States, Texas, the city and the Waterkeeper group, says they "have narrowed our differences in several respects." The settlement proposals under discussion would require the city to assess and repair its sewer lines, rehabilitate lift stations and force mains, run a formal program for managing the system's capacity and maintenance, carry out an early-action program for the collection system, and fix deficiencies at the treatment plants. The parties are also discussing civil penalty amounts. What remains in dispute, the filing says, are "appropriate milestones and deadlines for the proposed injunctive relief." The parties asked the court to extend the stay to October 23, 2026, with a status conference in mid-November.

A settlement of this kind is usually filed as a consent decree, a court-enforced agreement with a schedule. The filing says any settlement would be lodged with the court and opened for public comment. None had been filed as of late September 2026.

The city said in 2024 that since 2002 it had invested more than $220 million to improve its sewer system.

What it means for the budget

The city's adopted budget for the year that began October 1 lists "sewer capacity/compliance issues" among the priorities the City Council raised. Its five-year capital plan, totaling about $982 million, sets aside:

  • about $237.2 million for wastewater treatment, "to meet regulatory standards and support growth";
  • about $135.6 million for wastewater collection, the pipes and pump stations.

Together that is about $373 million, roughly 38 percent of the plan. Of that, about $56 million is in this year's adopted budget; the rest is projects already under way and future needs. Several of the sewer projects carry the label "CD-EAP" in the budget, including about $1.5 million to evaluate and rehabilitate trunk lines and about $14.4 million for overflow pipe replacements on Steinman Street and at the West Texas Avenue bridge. The budget's list of future projects, for 2028 through 2031, adds about $14.2 million for overflow pipe replacement at Garth Road and Northwood.

The same budget raised water rates 4.5 percent and sewer rates 12.4 percent, starting with the first full billing cycle after October 1. The city says the increases are needed to cover higher costs from the Baytown Area Water Authority, which treats the city's drinking water, and to maintain its water and wastewater systems. In its September 2026 legislative program, the city asked state lawmakers to let it use design-build contracts, which combine design and construction under one contract, for projects required by "consent decrees, enforcement actions, agreed orders, or similar regulatory requirements," because such projects "often must be completed within strict timelines."

Read the fine print

  • The overflow count in the lawsuit (more than 800 since April 2017) and the Waterkeeper group's count (882 from 2016 to 2021) cover different periods and come from different parties. Neither has been tested in court.
  • The lawsuit's claims are allegations. The city answered the complaint in June 2022.
  • The budget does not explain the "CD-EAP" label. We report it as printed.
  • Capital plan figures combine current projects, this year's money and future needs. Future needs are planned but not yet in a budget.
